Kim Zolciak’s 15-year-old son, Kroy “KJ” Biermann, has been indicted after his arrest.
The indictment, obtained by Us on Thursday, September 3, accuses KJ of aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under the age of 16.
KJ, one of Zolciak’s sons with estranged husband Kroy Biermann, was arrested on August 17 for aggravated sexual assault and aggravated sodomy. The teenager was accused of sexual misconduct by another minor, which he vehemently denied through an attorney.
“First and foremost, this is not the kind of information that should be for public dissemination. These are juveniles,” KJ’s attorney Jason Sheffield said in a statement shared with Us last month. “Secondly, my client is 100 percent innocent and tried to present evidence to the arresting officer, including a passed polygraph by a notable and respected sex offender polygrapher.”

Sheffield continued at the time, “Additionally, the officer’s report notes the [Georgia Bureau of Investigation] found no male DNA on or inside the areas the alleged victim claimed she was assaulted. Had the officer sat down with me, I feel certain she would’ve never made an arrest.”
KJ has not been arrested for the remaining charges in the indictment. Us reached out for comment.
Upon his arrest, a judge did not immediately set KJ’s bail and the high school student was remanded to the Metro Regional Youth Detention Center. According to a source, the juvenile detention center is seen as a holding facility where KJ has spent his time doing school work and homework.
“He’s doing the best he can at the moment. He does want to go home. He calls his mom every day,” the source told Us. “Kim can’t wait until he gets home and is praying to God this is over soon.”

Ahead of KJ’s hearing, his lawyers filed a motion on Wednesday, September 2, requesting their client’s release on bond.
“His ties to his family and community are substantial. His parents live separately, and he maintains a home and relationship with each,” the court docs read. “Beyond his immediate family, he is surrounded by an established community of extended family, friends, coaches, teachers and others who remain actively involved in his life and continue to support him and his family during the pendency of these serious allegations.”
Per the lawyers, KJ currently faces two felony charges that each carry mandatory minimum sentences of 25 years. If found guilty on both counts, KJ could possibly be sentenced to 50 years in jail.
A court hearing is scheduled for Wednesday, September 9.
Following news of his indictment, KJ’s attorney told Us in a statement on Thursday, “I respect the difficult responsibilities carried by prosecutors and victim advocates. Cases involving children require patience, care, and a commitment from all of us to understanding the full picture as the process continues.”
“There are two children at the center of this case. KJ was 14 years old when these events allegedly occurred. He was arrested at 15 and, less than three weeks later, indicted on charges carrying extraordinary consequences. But adult consequences do not transform a child into an adult. The choices and conduct of children should not suddenly be viewed through an adult lens simply because the consequences are severe,” Sheffield continued. “An arrest and an indictment cannot tell us the whole truth of a case because, at those stages, the magistrate judge and the grand jury have heard only one side. The accused has no right to participate, present evidence, cross-examine witnesses, or have a voice in the proceeding. That is not a criticism of the process; it is simply where we are.”
“Without DNA evidence, the case remains one of ‘she said, he said’ and the credibility of the accuser,” the attorney concluded. “The evidence that I have gathered will prove, at the appropriate time and place, that KJ Biermann is not guilty of these horrific allegations. God willing, that place will be juvenile court, where the lives of these young people can be respected and honored. Until then, these are children whose lives should not become something for adults to ‘thumbs up’ or ‘heart’ on social media. We should not cheer against children.”
