Influencer Haley Kalil Asks Court to Dismiss Ex Matt Kalil’s Lawsuit

Haley Kalil filed a motion for the dismissal of ex Matt Kalil‘s lawsuit against her following comments she made about the size of his penis.

According to court documents obtained by Us Weekly on Tuesday, January 27, Haley, 33, asked the court for the invasion of privacy and unjust enrichment lawsuit to be thrown out due to the influencer’s first amendment right.

“Plaintiff’s Complaint seeks to hold a woman in the public eye civilly liable for providing a truthful, autobiographical account of sexual trauma she suffered and described as having led to the end of a highly publicized celebrity marriage with an NFL football star,” the docs read. “Allowing this case to proceed as pled would require this Court to radically expand state-law causes of action beyond their recognized boundaries into territory fiercely protected by the First Amendment.”

Haley — who goes by the handle @haleybaylee online — was married to Matt, 36, from 2015 to 2022. Three years after their split, Haley spoke about her past marriage in a November 2025 livestream. The influencer framed “their relationship not as a failure, but as a loving union that was ultimately hindered by an unfortunate physical incompatibility,” per the docs.

In the livestream, Haley also claimed that the size of Matt’s penis was comparable to “two coke [cans] stacked on top of each other” or “maybe even a third.” The influencer shared that alleged size made physical intimacy “impossible,” adding that the situation was “bad luck” and no one’s fault.

According to Tuesday’s docs, Haley claimed that Kalil’s lawsuit “ignores the dominant theme of the speech and instead attempts to isolate the narrow subset of statements concerning the size of Plaintiff’s genitalia, asserting that those remarks were offensive and treating them as though they constituted the entirety of what was communicated.”

Matt’s lawyer Ryan Saba said in a statement to Us, “Haley Kalil’s motion to dismiss does not dispute the fact that she wantonly disclosed private and intimate details about Matt Kalil that resulted in widespread ridicule and unwanted attention. The motion completely misses the point that a spouse does not have a right to expose private and confidential marital and sexual details for the purpose of profiting. We expect that the motion will be completely denied.”

A judge has yet to make a decision. Us had reached out to Haley for comment.

Haley and Matt’s legal drama began earlier this year when the former football player sued his ex for invasion of privacy. Matt claimed in his filing that Haley’s words “implied that the size of [Matt’s] genitalia was a primary factor in the parties’ divorce and claimed that sexual intercourse … would leave her ‘in tears,’” according to court documents obtained by Us in January. Following Haley’s comments, Matt alleged that he was forced to “endure the ongoing public circulation of these degrading and deeply personal statements.”

Haley responded to the lawsuit in a statement to Us.

“I am genuinely shocked and incredibly hurt upon receiving the news of this filing. Litigation is a harrowing and emotionally draining experience, and I am heartbroken that he is choosing to subject us and our families to this ordeal,” the statement read, adding that Haley also complimented Matt several times during the livestream, including a moment where she called him the “greatest guy in the world.”
